Producers, manufacturers, importers: The roles of the PPWR – and their pitfalls
The PPWR distributes its obligations strictly according to roles – and in doing so, partly turns the terminology familiar from the Packaging Act on its head. Anyone who misallocates the roles will end up working on the wrong obligations. This article explains the role logic with all definitions and shows where roles can change.
Why the role question comes first
Every obligation in the PPWR is addressed to a role: conformity assessment and declaration to the producer Art. 15 PPWR, verification obligations for importers and distributors Art. 18, 19 PPWR, extended producer responsibility to the manufacturer Art. 3(1)(15) PPWR. A company can hold multiple roles simultaneously – and differently for each product line. What is decisive are the actual activities, not the self-assessment.
The Producer: Conformity
A producer is anyone who manufactures packaging or packaged products – or who has them developed or manufactured under their own name or brand, regardless of whether other brands appear on them Art. 3 Para. 1 No. 13 PPWR. For micro-enterprises with suppliers in the same Member State, the producer role can be transferred to the packaging supplier Art. 3(1)(13)(b) PPWR. The producer only places compliant packaging on the market, carries out the assessment procedure, draws up the technical documentation and provides the EU Declaration of Conformity from Art. 15(1)–(3) PPWR.
The manufacturer: product stewardship
The manufacturer is, in short, the producer, importer or distributor who places packaging or packaged products on the market in a member state provides for the first time (in the case of service packaging: makes available filled for the first time) or unpacks packaged products without being the final consumer; direct distribution to final consumers from abroad can also trigger the role Art. 3 para. 1 no. 15 lit. a–e PPWR. Registration and extended producer responsibility depend on this role. Art. 44, 45 PPWR. If the manufacturer is located in another country, the authorised representative for extended producer responsibility comes into play. Article 3(1)(20) PPWR.
importer, distributor and the other economic operators
- Importer: based in the Union, places packaging on the market from a third country Art. 3(1)(17) PPWR; checks inter alia prior to placing on the market whether the producer has completed evaluation procedures and documentation, and keeps a copy of the declaration of conformity available Art. 18(2), (7) PPWR.
- Distributor: makes packaging available on the market without being a producer or importer Article 3(1)(18) PPWR; ensures, among other things, that the manufacturer is registered Article 19(2) of the PPWR.
- Final distributor delivers packaged products to the end consumer Art. 3(1) point 21 of the PPWR.
- Supplier: supplies packaging or packaging material to a producer Art. 3(1)(16) PPWR.
- Fulfilment provider ensures that storage, handling and dispatch do not impair conformity Art. 20 PPWR.
- Authorised representative: carries out producer duties commissioned in writing, such as keeping declarations and documentation – but not creating them Art. 3 Para. 1 No. 19, Art. 17 PPWR.
When roles change: Own label and change
If an importer or distributor places packaging on the market under their own name or trademark – or modifies packaging already placed on the market in such a way that compliance may be affected – they shall themselves be considered the producer and assume their obligations Art. 21 PPWR. Especially for private labels and contract packers, this is the most frequently overlooked change of role: the duty to inspect turns into full conformity responsibility.
Frequently Asked Questions
What is the difference between a producer and a manufacturer in the PPWR?
The manufacturer (engl. manufacturer) produces packaging or has it produced under its own brand and bears the conformity obligations (Art. 3 para. 1 no. 13, Art. 15 PPWR). The producer (engl. producer) makes packaging or packaged products available for the first time in a Member State and bears the extended producer responsibility (Art. 3 para. 1 no. 15 PPWR).
Can a company have multiple roles?
Yes – the roles link to activities and can vary depending on the product line. For example, a company can be both a producer and a manufacturer for one line, and only a distributor for another.
When does a trader become a producer?
If he places packaging on the market under his own name or trademark, or modifies packaging already placed on the market in such a way that compliance may be affected (Article 21 PPWR).
